KuCoin Lawsuit Could Set Dangerous Precedent For Ethereum

The New York District Attorney General (NYDA), Letitia James, filed a lawsuit against crypto exchange KuCoin. According to a document filed with the Supreme Court of the State of New York against two companies running the trading venue in the U.S., PhoenixFin and Mek Global Limited.

The lawsuit accuses KuCoin of offering unregistered securities and commodities in New York. These digital assets are the former native token of Terra’s collapsed ecosystem, LUNA, its algorithmic stablecoin UST, and Ethereum (ETH), the second crypto by market capitalization. Read more...

Alameda, FTX Demand Grayscale To Unlock $9 Billion From BTC, ETH Trusts In New Lawsuit

Grayscale, the world’s largest Bitcoin fund, is being sued by Alameda and FTX on behalf of FTX’s debtors and affiliates.

According to a press release issued by the FTX Debtors on Monday, claims have also been filed directly against Grayscale CEO Michael Sonnenshein and Digital Currency Group (DCG) CEO Barry Silbert. Grayscale is owned by DCG.

The complaint by Alameda seeks to “unlock $ 9 billion or more in value for shareholders of the Grayscale Bitcoin and Ethereum Trusts,” according to a statement. Read more...

It was just over one year ago when we first highlighted the story of fashion house Hermès opening a lawsuit up against NFT creator Mason Rothschild. The story has come full circle as the lawsuit comes to a close on Wednesday, with jurors coming to a ruling in favor of the global fashion brand.

The ruling will undoubtedly serve as a pillar judgment in how NFT lawsuits – and potentially legislation – are evaluated in the years ahead.

SEC Lawsuit Against Gemini Is Political, Says Tyler Winklevoss

The U.S. Securities and Exchange Commission (SEC) announced on Thursday, January 12 it had filed charges against Genesis Global Capital LLC and Gemini Trust Company LLC. The charges bordered on the illegal sale of unregistered securities to numerous investors through a crypto lending program.

Tyler Winklevoss, a co-founder of Gemini, reacted to the announcement. In his opinion, the Securities and Exchange Commission (SEC) lawsuit will reduce the chances of users receiving their funds. Winklevoss reacting on Twitter, labeled the lawsuit as “rather disappointing.” Read more...

Grayscale: Decision In Bitcoin Spot ETF Lawsuit Vs. SEC Not Before Fall 2023

The fate of Genesis Trading, Digital Currency Group (DCG) and the Grayscale Bitcoin Trust (GBTC) continues to hang by a thread after Cameron Winklevoss took another step in the escalation over Gemini Earn customer funds with a new open letter on Tuesday. For Grayscale, however, the current battle is also about continuing to fight on the front lines against the U.S. Securities and Exchange Commission.

Craig Salm, chief legal officer (CLO) at Grayscale, revealed in a Twitter thread today that Grayscale will “soon” file the next brief in its lawsuit against the SEC, which is refusing to convert Grayscale Bitcoin Trust (GBTC) into a spot Bitcoin ETF. Read more...

Terra And Do Kwon Lawsuit Voluntarily Dismissed, But Why?

The plaintiffs in a class action lawsuit against TerraUSD and its affiliated companies voluntarily dismissed their case on Monday.

Matthew Albright filed the lawsuit on behalf of others against Terraform Labs (TFL), Pte Limited, and other affiliates in the Southern District of New York Court in August 2022.

The plaintiffs alleged that the defendants falsely promoted, manipulated, and offered UST stablecoin and LUNA. Zhu Su, a cofounder of failed crypto hedge fund Three Arrows Capital (3AC), announced the voluntary dismissal of the class action lawsuit via a tweet on January 10. Read more...

Silvergate Capital Slapped With Lawsuit Over Ties With FTX And Alameda

Several events are still unfolding following the collapse of FTX crypto exchange. The contagion from the exchange’s sudden collapse created panic among other crypto companies, especially those with exposure to the Sam Bankman-fried led exchange. Also, the shutdown of its sister company, Alameda Research, only added to the paranoia.

Silvergate Capital is one of the companies that is now in hot water, including Silvergate Bank and Silvergate Capital CEO Alan Lane, who are all facing a class-action suit for their connection with FTX.

Silvergate Capital is California-based Silvergate Bank’s parent company. The lawsuit was filed in the California Southern District Court. Read more...

Do Kwon, now a fugitive wanted by South Korean prosecutors and the Interpol, has a new fire to put out as more than 300 investors from Singapore decided to file a class action lawsuit against the Terra Labs co-founder.

The 357 capitalists from the Asian nation had no choice but to bring the fight to court as they lost $ 57 million. The plaintiffs claim that Do Kwon and his cohorts deceived them by making them believe that the value of the UST stablecoin is, as the word says, “stable” and will always be pegged to the U.S. dollar. Kardashian’s EthereumMax Lawsuit Turns Against SEC Chair

Earlier this week, the U.S. Securities and Exchange Commission (SEC) charged and settle a lawsuit with socialite and billionaire Kim Kardashian for allegedly withholding information about promoting EthereumMax. The influencer received $ 250,000 as compensation for leading her 330 million Instagram followers to a website whey they might have purchased the cryptocurrency.

The Commission received critics for the case against Kardashian, the socialite agreed to pay $ 1.4 million as per her settlement and to stop promoting crypto for 3 years. After Craig Wright’s sworn deposition, the plaintiffs contend that Wright’s categorical refusal to answer questions about his bitcoin addresses and his marriage(s) needs to be reevaluated. Wright’s legal team say he’s done everything possible to comply with the court’s orders but the Kleimans believe the self-proclaimed Satoshi has been stonewalling for nine months.

On April 28, the high profile Kleiman v. Wright lawsuit heated up when the plaintiffs alleged Craig Wright submitted forged evidence before the court. Following the recent response against Wright’s motion to dismiss the case, the plaintiffs also filed an order which demands a list of Wright’s public bitcoin addresses as of Dec. 31, 2013. Additionally, the Southern District Court of Florida Magistrate overseeing the lawsuit, Judge Bruce Reinhart, has signed the order.

The Southern District Court of Florida case, Kleiman v. Wright, continues to be one of the 10 most monitored court dockets in the state. On April 28, the Kleiman estate’s legal team responded to Wright’s most recent motion to dismiss the case by claiming that Wright submitted a forgery as evidence and allege the fraudulent imitation was created one year after David Kleiman’s death.
