If ICO's want to ensure freedom from prosecution they should follow the same strictures and governance regimes as other fund raising issues. There is a danger that unscrupulous businesses are trying to get round the legal requirements by classifying IPO's as ICO's. It will protect the honest coin issuers and adoption in general if the public know ICO's are not just an easy option for charlatans.
